Brigham and Women's and Massachusetts General Hospitals Institutional Policy re: Graduate Trainee Contracts

The following provisions apply to all graduate medical education training programs sponsored by the Brigham and Women’s and/or Massachusetts General Hospitals.

  • Programs shall provide those applicants who are invited for an interview with a copy of the current trainee contract template and other program-specific information regarding working conditions and amenities, as required by the ACGME. This shall be provided in writing and/or electronically (e.g., via directions to a website) at or before the time of the interview.
  • Sponsoring departments shall issue a contract to each graduate trainee for the term of one year. This contract shall be signed by the graduate trainee and by program leadership no later than the start of the trainee’s appointment or upon the trainee's arrival, if subsequent to that date. For multi-year GME programs the contract shall include information about the criteria for reappointment/renewal.
  • Sponsoring departments must use the Hospital's contract template for graduate trainees in ACGME-accredited programs. A separate template is provided for trainees in non-accredited GME programs. (Significant revisions shall be approved by the Director or Associate Director of GME or by the Partners Office of the General Counsel.)
  • Graduate trainees will not be asked or required to sign a non-competition guarantee.
  • The following provisions apply to programs that offer successive years of training:
    • A renewal contract will be issued to graduate trainees approved to continue in the program before the expiration date of the current appointment.
    • A decision not to renew a contract other than by mutual agreement will be provided to the graduate trainee in writing. The non-renewal notice will include a brief description of the grounds for this decision and will be delivered at least four months prior to the expiration date of the existing annual contract. However, if the primary reason/s for the non-renewal occur/s within the four months prior to the end of the agreement or if sufficient information necessary for the reappointment decision is not available at least four months prior to the expiration date, the program will provide the graduate trainee with as much advance notification of the intent not to renew as the circumstances will reasonably allow.
    • Graduate trainees may exercise their rights under the Graduate Trainee Adverse Action Process if and when notified that the contract will not be renewed.
